Legal Aspects of Mental Capacity aims to explain the significance of the provisions covering decision making on behalf of mentally incapacitated adults to health care workers.

It explores the background to the legislation including determination of capacity and the definition of best interests; analyses the key provisions of the Act including principles for governing decision making and the statutory duty to act in the best interests; and explores the role of various statutory bodies.
