The main purpose of the Act is to create a criminal offences in order to enforce the prohibitions set out in article 1 of the Convention on Cluster Munitions.

Article 1 of the Convention prohibits state parties from using, developing, producing, otherwise acquiring, stockpiling, retaining or transferring cluster munitions.

The article 1 prohibitions also apply to explosive bomblets that are specifically designed to be dispersed or released from dispensers affixed to aircraft.

The Act consists of 34 sections and extends to England and Wales, Scotland and Northern Ireland.
